Confidentiality
Stretched Fabric Systems consents to you using the thumbnail profile drawings which are found in the bottom right of each file (“the Thumbnails”) in architectural details. The definition of the Thumbnails does not include any measurements except “Actual Size” in millimetres squared. Stretched Fabric Systems allows the Thumbnails to be modified as necessary and without further permission, enabling their use in architectural details to be shown to your clients and other third parties.
By accessing the Stretched Fabric Systems download area (“the Area”), you agree to keep any information, other than the Thumbnails, that you download from the Area strictly confidential (“the Confidential Information”).
You will maintain the Confidential Information in the strictest confidence and will not divulge any of the Confidential Information to any third party without our prior written permission.
You will restrict access to the Confidential Information only to such of your employees as need to have access to the same and will procure that any employees to whom the Confidential Information is disclosed will keep the same confidential.
You acknowledge our proprietary rights in the Confidential Information and that the disclosure of the Confidential Information shall not be deemed to confer upon you any rights whatsoever in respect of any part thereof.
You will confirm to us in writing at any time on request that you have complied with the provisions hereof and if so requested shall provide a statutory declaration to the effect that no Confidential Information (in whatever medium) has been used or disclosed to any third party by you in breach of the terms of this agreement.
